What EU Cosmetic Label Regulations Require

EU Regulation EC 1223/2009 is the cornerstone of cosmetic regulation in the European Union. Effective since July 2013, it governs the safety, labelling, marketing, and surveillance of all cosmetic products sold to EU consumers — from skincare and haircare to makeup, perfumes, and toothpaste.

The regulation applies to any brand — EU-based or international — whose products reach EU consumers. Non-EU brands must appoint an EU-based Responsible Person (RP) before placing any product on the market. The RP's name and address must appear on the label.

Key compliance areas include: accurate INCI ingredient listing, allergen declarations (updated under Regulation 2023/1545 to 80+ substances), claims compliance under EC 655/2013, safety assessment documentation, and CPNP portal notification before sale.

The 14 Mandatory EU Cosmetic Label Elements

Article 19 of EC 1223/2009 sets out the mandatory information that must appear on cosmetic product labels and/or packaging. Missing any element risks non-compliance:

1

Must be EU-established entity

2

Country of origin

Required for products manufactured outside the EU

3

Nominal content (weight/volume)

In metric units (g, ml, etc.)

4

"Best before" date or PAO symbol (open jar)

5

Special precautions for use

Especially for professional-use products

6

Batch number or lot code

For product traceability and recall capability

7

Unless obvious from presentation

8

Updated Allergen Requirements (Regulation 2023/1545)

One of the most significant recent changes to EU cosmetic labelling is Commission Regulation 2023/1545, which expanded the list of fragrance allergens that must be declared on cosmetic labels.

Before 2023/1545

26 allergens required declaration

Thresholds: 0.01% leave-on / 0.001% rinse-off

After 2023/1545

80+ allergens must be declared

Same thresholds, but far more substances covered

Each allergen must be listed by its INCI name in the ingredient list. If your formulator hasn't updated your INCI list since 2023, your label may already be non-compliant — even if it passed previous checks. Our full label audit cross-references your INCI list against all 80+ allergens.

Country-Specific EU Labelling Rules

Beyond the EU-wide regulation, individual member states have additional requirements that brands selling in those markets must comply with:

🇫🇷 France

  • Triman recycling symbol mandatory since 2022
  • All mandatory label text in French
  • ANSM notification for certain product categories
  • Extended producer responsibility labelling

🇩🇪 Germany

  • BVL product notifications required
  • German language for mandatory information
  • Strict enforcement of claims regulation
  • GfK-tracked compliance monitoring

🇮🇹 Italy

  • ISS (Istituto Superiore di Sanità) notification
  • Italian language for mandatory info
  • Specific colorant restrictions enforced

🇪🇸 Spain

  • AEMPS (Agencia Española de Medicamentos) notification
  • Spanish language requirements
  • Castilian language minimum requirement

Penalties for Non-Compliant Cosmetic Labels

The consequences of non-compliant cosmetic labels in the EU are serious and can affect both small brands and large multinationals:

⚖️

Financial Penalties

Fines up to €300,000 in France. Germany: up to €50,000 per violation. Italy and Spain have similar frameworks.

🚫

Market Withdrawal

Authorities can force removal of non-compliant products from all EU retail channels — online and offline.

📦

Product Recalls

A recall can cost 5–20× the original compliance investment. EU-wide RAPEX alerts are public and damage brand reputation.
